Mother of murdered teen files lawsuit

"I stood out here in the rain and the cold. I come here because this is it," said Kim Perham.


Each month, Kim Perham places flowers off Mount Hope Drive, where her 14-year-old daughter Gretchen was found dead in May. No one has been charged with the crime and Perham said she is fed-up waiting for justice.


She said, "Her smile, just the laughter, just the person she was and is -- she was wonderful."


Perhaps what makes this crime even more difficult to understand is that Gretchen's body was thrown down a ravine, just feet from the highway.


Perham said, "This is like a garbage place, like a dump, and Gretchen was not garbage. She was a very smart person, loving and caring."


Now Kim Perham's attorney John Aretakis is trying to find out if convicted rapist Darius Ashley had anything to do with the crime.


Ashley is serving 25 years in prison for rape and kidnapping. Investigators are looking into an alleged confession in jail, even though he told Capital News 9 he didn't do it.


Darius Ashley said, "It's not me. And if it makes them feel better to say it's me, then OK. But just remember, I told you so. "


Now Ashley is named in a lawsuit along with Parsons Child and Family Center. Ashley was fired from his job as a cook there a week after Perham's body was found.

Aretakis said Ashley may have had contact with children at the center. The attorney wants to know if he did, and if so, why he wasn't reported to authorities.


Aretakis said, "They may have been negligent in allowing him to go free and set into motion a series of crimes."


Mother files lawsuit
The mother of a murdered teen is filing a lawsuit against the Parsons Child and Family Center in Albany.
Parsons spokesperson Karen Mantas told Capital News 9 it's their "policy to not give out personnel files without a subpoena." She said they've "been cooperative with police" and want whoever committed the crime caught.


As Perham waits to find out what role Ashley's job may play in the case, she just hopes what she does now somehow makes a difference.


She said, "It's not just Gretchen, it's a lot of children, and I wish I could do something, you know, to help, or help people before they do something like this because once they do it you can't take it back."
