QUEENSBURY, N.Y. -- Capital News 9 has learned that the grandmother of missing Jaliek Rainwalker has been denied custody.

In the unusual request, Barbara Reely had filed for legal guardianship of Jaliek back in May. Reely told the court that Jaliek's adoptive father, Steven Kerr, was abusive toward Jaliek before he disappeared. Reely also maintained that Kerr and his wife should have done more to help in the search.

However, this week, a Warren County court dismissed the case and ruled that Jaliek's adoptive parents would retain custody. They have 30 days to appeal.

Stephen Kerr was the last person seen with Jaliek on November 1st, the day he disappeared. He has been named a person of interest in the case but was never charged.
