TROY, N.Y. -- A Supreme Court justice from Troy has recused himself from litigation in Mayor Harry Tutunjian's lawsuit against the city council.
Tutunjian is suing over the council's decision to override his veto concerning pay raises for appointed employees.
The lawsuit would put a temporary restraining order in place, stopping the council from cutting their salaries.
Justice Henry Zwack took himself off the case after court documents revealed that he made impartial comments about the case to the city council president.
