Guilty pleas in "man cave" case

ALBANY, N.Y. -- Two state employees accused of creating a secret hideaway where they'd use and sell drugs and sleep during their shifts have entered guilty pleas in Albany County Court.

A 22-count alleged that cleaning crew supervisor Louis Marciano, 50, of Rensselaer, and janitor Gary Pivoda, 48, of Latham, regularly used a storage area in Albany's East Parking Garage that was converted to a concealed "man cave" so they could get high and sleep while they were supposed to be working. They were also accused of using and selling marijuana and cocaine at the location and filing false information on their time sheets.

The Inspector General's Office and State Police raided the location on July 14.

Pivoda pleaded guilty to defrauding the government and third-degree grand larceny. His plea agreement includes one year in Albany County Jail, paying $2,000 in restitution for hours not worked, resignation from his current position, and a lifetime ban from state employment.

Marciano pleaded guilty to defrauding the government. His plea agreement includes five years probation, 250 hours of community service, paying $1,500 in restitution, resignation from his current position, and a lifetime ban from state employment.

Sentencing is scheduled for Jan. 4. Both have waived their right to appeal.
