CAPITAL REGION, N.Y. -- Some health care workers continue to protest the statewide mandate that requires them to get both the seasonal and H1N1 flu vaccines by November 30th.

Capital Region attorney Terry Kindlon is taking on the case pro bono. He says his clients, four Albany Medical Center nurses, will be filing a lawsuit against the commissioner of health next week. Many health care employees say the requirement is a violation of workers civil rights.

You'll remember hundreds of health care workers from across the state protested the decision in Albany two weeks ago. State Health Commissioner Dr. Richard Daines says the move is no different than with the other mandated vaccinations workers are already required to receive if they work in the health care field in New York.
